PRIVACY POLICY


  1. Introduction and Scope

Foundation Incubator (“Foundation,” “we,” “us,” or “our”), a [Delaware] entity operating the proprietary, invitation-only Platform at https://foundation-incubator.com (the “Platform”), is committed to protecting the privacy and confidentiality of all Participants.

This Privacy Policy explains how we collect, use, disclose, and safeguard personal information and other data when you access or use the Platform in any capacity (as a Builder, including minors under 18, Mentor, Investor, Partner Company, Donor, or their authorized representatives/guardians).

This Policy is incorporated by reference into and forms an integral part of:

  • the Platform Terms of Service (“TOS”),
  • the Non-Disclosure Agreement (“NDA”),
  • the Program Terms Addendum, and
  • the Builder Intellectual Property Ownership, Collaboration and Equity Agreement (for Builders).

By accessing the Platform, you expressly consent to the practices described herein. If you do not agree, you must not use the Platform. Capitalized terms not defined here have the meanings given in the TOS, NDA, or Program Addendum.

  1. Information We Collect

We collect the following categories of information:

2.1 Personal Information

  • Account and profile data: full legal name, email, phone, date of birth, government-issued ID (for verification), role on the Platform (Builder, Mentor, Investor, etc.), and guardian information (for Builders under 18).
  • Demographic and background data voluntarily provided during onboarding or in the Community Hub.
  • Payment or donation information (processed by third-party providers; we do not store full card details).

2.2 Sensitive Personal Information

  • Psychological, social-work, counseling, health, or personal-barrier-removal data shared during private support sessions (only with explicit, documented consent).
  • Any information concerning minor Builders that could be considered “sensitive” under applicable law (e.g., family situation, mental health, or social support needs).

2.3 Platform Usage and Communications Data

  • All activity in the Community Hub: messages, matching requests, project discussions, collaboration workspace content, feedback, and introductions between Mentors/Builders/Investors.
  • Project-related data: inventions, code, prototypes, business plans, roadmaps, and any other materials developed or posted inside the Platform (“Project Data”).
  • Technical data: IP address, device identifiers, browser type, access logs, and usage analytics (collected automatically).

2.4 Jointly Owned Project IP Data All Projects and Project IP developed inside the Platform are jointly owned by the Builder (and authorized team) and the Foundation (as set forth in the IP & Equity Agreement). This includes all derivative works, analyses, and records of development within the Platform.

2.5 Children’s / Minor Data For Builders under 18, we collect guardian contact and consent information. We do not knowingly collect personal information from children under 13 without verifiable parental consent in compliance with the Children’s Online Privacy Protection Act (“COPPA”).

  1. How We Collect Information
  • Directly from you: during onboarding, profile creation, Community Hub activity, private support sessions, or communications with the Foundation.
  • Automatically: through cookies, server logs, and analytics tools (see Section 9).
  • From third parties: licensed social workers, psychologists, or background-verification services (all bound by the NDA and equivalent confidentiality obligations).
  • From other Participants: only through approved, role-based matching in the Community Hub and solely as permitted by the NDA and Program Addendum.
  1. How We Use Your Information

We use the collected information solely to: (a) provide, operate, maintain, and improve the Platform, Community Hub matching, and private support services; (b) facilitate curated introductions and collaboration strictly within the Permitted Purpose (as defined in the NDA); (c) administer joint ownership of Project IP and support commercialization decisions under the IP & Equity Agreement; (d) deliver psychological, social-work, or personal-support services through licensed providers; (e) enforce the NDA, Program Addendum, TOS, and IP & Equity Agreement (including monitoring for compliance); (f) comply with legal obligations, respond to lawful requests, or protect the safety of Participants (especially minor Builders); (g) conduct internal analytics and Platform improvement (data is de-identified where possible); and (h) communicate important notices regarding your account or the Platform.

We do not use your information for behavioral advertising, profiling for third-party marketing, or any purpose outside the Platform ecosystem.

  1. How We Share and Disclose Information

We share information only in the following limited circumstances, all subject to strict confidentiality:

5.1 Within the Platform Ecosystem

  • Matched Participants (e.g., Mentor sees limited Builder profile and Project Data necessary for guidance; Investor sees only Foundation-approved “ready-to-fund” Projects). All such sharing is governed by the NDA and Program Addendum.

5.2 Service Providers and Agents

  • Licensed psychologists, social workers, or technical providers who are contractually bound by the NDA (or equivalent) and act solely on our behalf.

5.3 Legal and Safety Requirements

  • To comply with law, court order, or governmental request; to protect the rights, property, or safety of the Foundation, Participants, or the public (especially minors).

5.4 Corporate Transactions

  • In the event of a merger, acquisition, or sale of assets, with the successor bound by this Policy.

We do not sell, rent, or trade personal information to third parties for marketing purposes. Project Data that is jointly owned may be retained and used by the Foundation as co-owner in accordance with the IP & Equity Agreement.

  1. Data Security

We implement and maintain reasonable and appropriate administrative, technical, and physical safeguards designed to protect the confidentiality, integrity, and availability of your information, consistent with the sensitivity of the data (including encryption in transit and at rest, access controls, and regular security audits).

However, no system is infallible. You acknowledge that absolute security cannot be guaranteed and that any transmission of data is at your own risk. You must maintain the confidentiality of your account credentials.

  1. Data Retention

We retain information for as long as necessary to fulfill the purposes outlined in this Policy and the governing agreements, or as required by law. Confidentiality obligations under the NDA survive termination of your access indefinitely (or for the periods stated therein). Jointly owned Project IP is retained as long as the co-ownership rights exist. Upon a valid deletion request (subject to legal and contractual limitations), we will delete or de-identify personal information where possible, except for archival copies required for legal compliance.

  1. Your Privacy Rights

Depending on your jurisdiction, you may have the following rights (subject to verification and contractual limitations):

  • Access, correct, or update your personal information.
  • Request deletion of personal information (subject to joint-ownership rights in Project IP, ongoing NDA obligations, and legal retention requirements).
  • Object to or restrict certain processing.
  • Data portability (where technically feasible).

For California residents: you have additional rights under the California Consumer Privacy Act (CCPA/CPRA), including the right to know, delete, and opt-out of any “sale” of personal information (we do not sell data).

For EU/UK residents: you have rights under the GDPR, including the right to withdraw consent where processing is based on consent.

To exercise any right, contact us at the details in Section 12. We will respond within the time required by applicable law. Note that deletion of Project IP may be limited because it is jointly owned. Minor Builders’ guardians may exercise rights on their behalf.

  1. Cookies, Tracking Technologies, and Analytics

We use essential cookies and similar technologies to operate the Platform, maintain security, and analyze usage (anonymized where possible). You may manage cookie preferences through your browser settings; however, disabling essential cookies may prevent Platform access. We do not use tracking for cross-site advertising.

  1. International Data Transfers

The Foundation is based in the United States. When we transfer personal data outside your jurisdiction (including to the U.S.), we use appropriate safeguards such as standard contractual clauses or equivalent mechanisms required by applicable law. By using the Platform, you consent to such transfers.

  1. Children and Minor Builders

We take extra precautions for minor Builders (under 18). Guardian consent is required for account creation and ongoing participation. Private support services for minors are provided only with guardian awareness and consent where legally required. We comply with COPPA for users under 13 and applicable state children’s privacy laws. If you believe we have collected data from a child under 13 without verifiable parental consent, please contact us immediately.

  1. Changes to This Privacy Policy

We may update this Policy from time to time. We will notify you of material changes by posting the revised Policy on the Platform with a new Effective Date and, where required by law, via email or Platform notice. Your continued use after the Effective Date constitutes acceptance of the updated Policy.
