PLATFORM APPLICATION ATTEMPT AND INTEGRITY POLICY
(“Attempt Policy”)
Parties: Foundation Incubator (the “Foundation,” “we,” “us,” or “Platform Operator”), a Delaware corporation, and any individual or entity submitting an application to access the Platform (each an “Applicant” or “you”). If the Applicant is under the age of 18, the Applicant’s parent or legal guardian must also execute this Policy on behalf of the minor and in the Guardian’s individual capacity.
Recitals
WHEREAS, the Foundation operates a proprietary, invitation-only, elite full-spectrum Platform that selects only the rarest tech geniuses (“Builders”) and the most aligned Mentors, Investors, Partner Companies, and Donors who share the Foundation’s core values of absolute transparency, loyalty, integrity, and long-term commitment to world-changing positive impact;
WHEREAS, acceptance onto the Platform is a privilege granted only to those who demonstrate unwavering honesty and trustworthiness at every stage of the application process;
WHEREAS, the Foundation has implemented a rigorous, multi-phase selection process (including challenges for Builders and background verification for all Applicants) to protect the integrity of the ecosystem and ensure that only the most loyal and transparent partners gain access;
WHEREAS, the Foundation maintains strict rules governing the number of application attempts, cooldown periods, detection of circumvention tactics, and zero-tolerance consequences for any material misrepresentation or dishonesty; and
WHEREAS, this Attempt Policy is incorporated by reference into and forms an integral part of the Non-Disclosure Agreement, Program Terms Addendum, Platform Terms of Service, Privacy Policy, Data Processing Notice and Addendum, and (for Builders) the Builder Intellectual Property Ownership, Collaboration and Equity Agreement;
NOW, THEREFORE, by submitting any application to the Platform, you expressly acknowledge, understand, and agree to be bound by the terms of this Attempt Policy.
- Definitions
1.1 “Application” means any submission, form, profile, video, challenge response, or other materials provided by an Applicant seeking access to the Platform in any capacity (Builder, Mentor, Investor, Partner Company, Donor, or team member).
1.2 “Attempt” means a complete and submitted Application.
1.3 “Failure” means any Application that is not approved by the Foundation in its sole and absolute discretion. Or abandoned mid-process.
1.4 “Material Misrepresentation” or “Lie” means any false, misleading, incomplete, or inaccurate statement or omission in an Application (including but not limited to background, experience, achievements, affiliations, or any other information), whether intentional or not. A single lie in any part of the Application constitutes a Material Misrepresentation.
1.5 “Duplicate Applicant” means any attempt to circumvent cooldown periods or bans by submitting multiple Applications under different names, emails, identities, entities, or any other method of evasion.
1.6 “Phases” means the Foundation’s multi-stage selection process (Phase 1: initial Application; Phase 2: challenges/assessments for Builders; Phase 3: final review, interviews, and verification).
- General Principles
The Platform is built on absolute trust. Any conduct that undermines transparency, honesty, or loyalty is fundamentally incompatible with participation. The Foundation’s decisions under this Policy are final, non-appealable, and made in its sole discretion.
- Rules Specific to Builders
3.1 Maximum Number of Attempts. Builders are permitted a maximum of three (3) Attempts in their lifetime.
3.2 Cooldown Periods. (a) If the first Attempt results in Failure, the Builder must wait six (6) months from the date of notification of Failure before submitting a second Attempt. (b) If the second Attempt results in Failure, the Builder must wait another six (6) months from the date of notification of the second Failure before submitting a third (and final) Attempt. (c) If the third Attempt results in Failure, the Builder is permanently banned from the Platform and any future Applications.
3.3 Detection of Duplicate or Circumventing Applications. Any attempt to evade the cooldown periods or lifetime ban through Duplicate Applicant tactics (different identities, emails, proxies, family members, or any other method) will result in immediate lifetime ban for the Applicant and all associated individuals/entities. The Foundation employs advanced safeguards to detect such circumvention.
3.4 Zero-Tolerance for Material Misrepresentations. If the Foundation discovers a Material Misrepresentation at any time, even after the Applicant has passed Phase 1 and advanced to Phase 2 or Phase 3 challenges, the Applicant is immediately and permanently banned for life. This ban applies regardless of how far the Applicant progressed or whether they would otherwise have been accepted.
- Rules Specific to Non-Builder Applicants (Mentors, Investors, Partner Companies, Donors)
4.1 Non-Builder Applications do not involve technical challenges; acceptance is based solely on background verification and alignment with Foundation values.
4.2 Zero-Tolerance for Material Misrepresentations. Any Material Misrepresentation discovered at any time (during initial review or after provisional acceptance) will result in immediate and permanent lifetime ban for the Applicant and any associated entities.
- Enforcement and Consequences
5.1 Lifetime Ban. A lifetime ban means:
- Permanent denial of all future Applications;
- Immediate termination of any existing Platform access (if already granted);
- All confidentiality obligations, non-circumvention rules, and intellectual-property restrictions survive the ban indefinitely; and
- The Foundation may notify other Participants or third parties as reasonably necessary to protect the ecosystem.
5.2 No Appeals. All decisions regarding Failures, cooldowns, bans, or Material Misrepresentations are final and non-appealable.
5.3 Reporting and Cooperation. Applicants must immediately report any suspected violation of this Policy by others. The Foundation may require additional verification or interviews at any stage.
- Remedies
Any breach of this Attempt Policy constitutes a material breach of all Platform agreements and may cause irreparable harm. The Foundation is entitled to immediate injunctive relief, specific performance, and all other legal and equitable remedies, including recovery of attorneys’ fees and costs.
- Survival
All obligations under this Attempt Policy survive termination of any Application process, denial of access, or lifetime ban.
- Governing Law and Miscellaneous
This Attempt Policy is governed by the laws of the State of Delaware, without regard to conflict of laws principles. Exclusive jurisdiction and venue lie in the state and federal courts located in Wilmington, Delaware. This Policy, together with all other Platform agreements, constitutes the entire understanding between the parties regarding application attempts and integrity. Amendments may be made by the Foundation with notice via the Platform or email. Electronic signatures and acknowledgments (including via the Platform onboarding flow) are binding.
IN WITNESS WHEREOF, by submitting an Application to the Platform, the Applicant (and Guardian, if applicable) acknowledges having read, understood, and agreed to be bound by this Attempt Policy in its entirety.
